Rules and Regulations To Know For Listing Your Property in Kuwait  

It is important to know about the rules and regulation before listing your apartment, property in Kuwait. Some of these include: - 

1. Listing and Rental Rules 

Written and Notarized Contracts 

  • All lease contracts must be in writing, signed by both parties, and notarized at the Ministry of Justice.  
  • This process makes the agreement legally binding and enforceable, which is required for both residential and commercial properties. 

Contract Details 

  • The contract must clearly specify the rent amount and the payment date.  
  • Both the landlord and tenant must appear before a notary public to finalize the contract.  

Rent Collection 

  • If a tenant fails to pay rent, the landlord must issue a formal notice and provide proof of non-payment before initiating legal proceedings.  
  • Notarized contracts can expedite the rent collection process through the courts. 

Appeals and Disputes 

  • Appeals against rental court rulings must be filed with the Court of Appeal or, following recent amendments, with the Court of First Instance in its appellate capacity. 

2. Property Ownership and Sale Rules 

Kuwaiti Nationals and GCC Citizens 

  • Traditionally, only Kuwaitis, GCC citizens, and diplomatic entities could own property.  
  • However, recent reforms have expanded these rights.  

Expatriates 

Starting in 2025, expatriates can own property under specific conditions: - 

  • Ownership is generally limited to residential properties, usually allowing only one home not exceeding 1,000 square meters. 
  • Non-GCC buyers must have lived in Kuwait for at least 10 years before being eligible to purchase property. 
  • Exceptions exist for Arab nationals inheriting property from Kuwaiti mothers, who are exempt from mandatory sale requirements.  

Registration 

  • All property transactions must be registered with the Real Estate Registration Department at the Ministry of Justice.
